Can I File Bankruptcy after Foreclosure?

I am procrastinating, I have three more lines to fill in on my Bankruptcy forms. Three lines to freedom, I have been avoiding writing about it too. I am ashamed. I thought I could fix this with out bankruptcy…I felt like if I had to file bankruptcy after foreclosure I didn’t deserve the financial freedom I so desperately longed and worked for. I was wrong.

Lets start at last June- after my surgery and Bretts broken elbow and surgery the medical bills started pouring in, then we were hit with a brick (for lack of a better word). Our second mortgage was going to sue us for $75,000. Ouch. We started to search desperately, we had so many questions and so few answers. The first was…

Can I file bankruptcy after foreclosure?
Yes, Yes, YES!! Yes, you can, we are. Not only can we, but we will be getting rid of virtually all our debt. We don’t have student loans or IRS debt, which are both exempt from bankruptcy, so we don’t have to worry about that. Although the prospect of having to sell all our belongings (which are few and far between) to pay back debt makes me very nervous!

If I can file bankruptcy after foreclosure, which chapter do I file?
This was our next question, we researched and then decided we should be filing Chapter 7. Chapter 7 is also referred to liquidation case (hence my apprehension). Our lawyer basically broke it down like this- we would fill out forms HONESTLY and then we would be assigned a Trustee who would then decide what was exempt and non-exempt assets, based on a certain amount of equity in our property (furnishings, personal property, vehicles, life insurance, etc.).

Now that I know I can file bankruptcy after foreclosure, who do I contact?
I called every bankruptcy lawyer in the Denver/Boulder area and decided on a lawyer in Erie. He seemed to know his shit and had the confidence I lack in this situation. Bankruptcy lawyers definitely vary in price, the can cost at little as $900 and as much as $3000, ours is about $2400, he seems really well versed in our type of situation so we opted for him.

Can I file bankruptcy after foreclosure and ever buy a house again?
This was my final question, which was subsequently answered in a packet of papers from our attorney- we are looking roughly 4-7 years before we qualify for a loan again, hopefully since we will be debt free and living frugally we will be able to save a decent down payment by then.

Our bankruptcy still makes want to cry, it makes me nervous and I have a lot of anxiety surrounding it. This doesn’t mean it isn’t the right choice for us right now, it is. It means I haven’t done this yet and I am afraid of the recovery or what it will look like for us in the future. Honestly I am kind of scared to be debt free, I am afraid I may make the same bade choices again and forget all that I have learned. I most likely won’t because I am such a freak now, but one never knows.

Mommy Wars and Truffles

I promised a new blog post with a delish recipe for truffles but as usual I am a week late :-/ LOL

I also mentioned a vent that would be coming (if you are Facebook friends you know this)

WELL lets start with the vent! I was at Bretts classroom party and he goes to dig into the truffles I brought; I realize they are yummy and a hit so I made FORTY! He took 3 (mind you he can’t eat anything else on the table due to cross contaminants) wellll this mom who was running the party gets all up in my grill because he took 3 instead of the one she was instructing each kiddo to take. I get this can possibly pose an issue, but every other kid also has two cookies, fruit and goldfish. I just politely say well I made them for him because he is allergic to dairy and eggs. She gets all defensive and goes super loud ‘OH HES THAT KID!’ I about bitch slapped her right there and then but I stepped back collected myself and said ‘yup he is that kid’, the little girl next to him asked what that meant so I calmly told her he was really allergic to eggs sand milk and that they could kill him, her response was sooo cuteโ€ฆIm allergic to dust, it makes me sneeze! Well back to this lady and she is all well did you even make 25? (number of kids in class) and I said I made 40 at least and she goes well there aren’t 40 here (the two tables that had come before us all the kids took 2!) AHHHHH So that is my vent, when you know what its like to raise THAT KID and fight with doctors and worry about reactions, then you can step to me, until then bite me. Oh and lady stop acting like you’re five years old too.

Vegan Truffles
1- 8 oz container tofutti
1- package Oreos
colored granulated sugar

I used my kitchen aid mixer and put all the Oreos and tofutti in and let it mix. Once well mixed use a spoon and spoon out mixture and roll into balls and place on parchment paper. Repeat 40 ish times ๐Ÿ˜‰ place in fridge to set for at least an hour. Remove roll in sugar, put back in fridge for at least 15 minutes. Eat!!

Back To The Real World

Our life has been hoppin lately! We are currently sitting on an airplane on our way home to Colorado from Florida (had a fantastic time with friends from high school) we left from Florida to the Bahamas on 5 day cruise (if you ever have a chance to hit up Freeport it is Divine as is Atlantis *SOO MUCH FUN*) 
I am sharing some awesome pictures from the beach and snorkelingโ€ฆ.including our swimming adventures with a friggin barracuda *bahhh* 
okay I know y’all want to know the highlights of our trip zoo here is the not so party kid guide to cruising (and not dying too much)
*Go with a Corporate group who will pay for you because than you can afford all the alcohol and shore excursions
*Make sure you pay your bills before you leave, you will not be able to afford them when you get home
*Freestyle cruise is amazing and has soo much food you may get fat- much like I did
*Within your corporate group, seek out those who appear to have children, then drink with them. Just like you they have no desire to see shows and shit, they want to get drunk
*If you are lucky you will find crazy Canadians and maybe they will get deported too bahahahaha that was a highlight that I am not at liberty to talk about ๐Ÿ˜‰
*Over all just enjoy yourselves, the food is yummy and someone else will clean up after you 
I can honestly say I can’t wait for Corey to win next years cruise because it was seriously phenomenal and having time back home didn’t hurt ๐Ÿ™‚ We also finally bought a new computer which means while we still won’t have internet at home we will now have a none iPhone way of posting blogs and I can legit type up recipes and post for y’all ๐Ÿ™‚

Running Around The World

Okay, well that may be a little over the top, I am not really running around the world (but I would freaking love to!) But I did just sign up for my first ever HALF MARATHON!!!!!!!!! The Colfax Marathon which is a benefit Marathon for Kaiser and supports all these super orginaztions in the Denver area ๐Ÿ™‚ I know doing a half is a little wuss but I am running Tough Mudder the next month and there is no way I can train for both :/

So, back to Colfax Marathon…its May 19th and I will be running it with a few of my super awesome friends (I would love to have more join us!) I am using Hal Higdons Half Marathon Novice2 right now and in a few weeks I am going to be upping it to Intermediate because well I run too much for the current progam, although if you are a novice runner I do think it is AWESOME!

Last month I made my goal of 100 miles as many of you know ๐Ÿ™‚ I actually hit 101 and I have to say it rocked ๐Ÿ™‚ In a huge way minus of course the illness at the end but hey what can I say?! I wanted to touch on awesome running and shoes. A lot of my friends have asked me what shoes they should wear, well that is a complex question running shoes are not a one size (or shoe) fits all we all run different I love love love to run ‘barefoot’ I run in Merrills on the road and in Vibrams on the treadmill! They are perfect for me but I have a near perfect gait and work hard to keep it that way, this is not the case with most runners!! I will repeat, this is not the case with most runners!!!!!!! Go to a real running store and get fitted I love Road Runners because they are uber patient and awesome, they are also the only running store I have been in. So, before you run, get fitted, its worth the $100 for the right shoes and lack of shin splints, hip injuries, knee pain, etc, etc!

Food

So my lovely husband brought up the subject of food idolization last night. We obsess about it, love it, hate it, need it- and so on. I love food, I do, I love meal planning, cooking and what not. I went to the library and now I’m working on my meal plan for this week- whole foods, real foods, tasty and healthy foods. Wish me luck

Happy New Year!!

It’s the last day of 2012! I am so happy to say, this year has been awesome. I have cooked in healthier way, I have enjoyed my family and friends. I have learned more about Jesus than I have known before.

I have also had my fair share of heart break. I lost my grandfather, watched my friends through divorces. Cried for school children and lost pieces of my faith in humanity.

I look into 2013, at my aspirations and I am excited to share them with y’all, but for today I am going to just write out a recipe and enjoy the holiday with my family!!

Veggie Lasagna Soup

2 cupsOnion; chopped
1 cupCarrot; diced
2 TGarlic; minced
4 cupsChicken broth
1 canStewed tomatoes; Italian-style
1 cup spaghetti
2 cupsSpinach; chopped
1 cupProvolone or fresh mozzerella; diced
1/4 cupParmesan cheese; shredded
4 tBasil; fresh, thinly sliced
Preparation

Onion and carrot: saute 3 minutes. Stir in garlic, and saute another 3 minutes.
Add broth and tomatoes: bring to a boil. Stir in pasta and simmer uncooked, about 10 minutes (or according to package directions). Add the spinach and cook about 1 minute, or until wilted.
To serve, place cubes of cheese in each serving bowl, then ladle over soup to melt. Garnish with Parmesan and basil.

Oh and for an end of year weigh in!! I have gained 2 lbs but lost 3 inches with a 1/2 in gain in my arms and 1 inch gain in my thighs
Since I am at my starting weight I’m going to put my first pics and pics from today so y’all can see what muscle looks like

I love Jesus

I really do and I really want to help my kids know Jesus cus I think he’s the cats meow. This Christmas we got the boys a bible and it appears if I read them one story a day we can read and write about God and his awesomeness and finish the bible In pictures by the end of 2013. I hope I can teach my kids to love Jesus like I do.

Merry Christmas Eve

It’s that time of year, when Santa comes and Jesus wasn’t really born, the year ends and we realize we have wasted out time on iPhones and doing pointless shit. Oh and don’t forget we promise we will do better next year, but we wont, not really.

This Christmas I look back at the last year, at the loss of my grandfather and the growth of my children. I wish I had spent less time of Facebook and more time on them. This year I will. I am happy to spend my holiday with my friends and my family.

This Christmas I will rejoice in the fact that Jesus was born albeit not at christmas time, that I have a family that loves me and my life.

Addressing The Already Addressed

As I stand in my seven year old sons class, safe, having signed in, police making themselves seen, happy…I think to myself, how do you address a topic that has been addressed by, well, everyone?

For me- it’s talking about the nitty gritty, what we are all saying at home but no one is saying in public.

The Devil himself would probably find this to be some seriously fucked up shit. Because it is fucked up. When you shoot 20 small children it’s fucked up- no ifs, ands or buts about it. You can’t do that, it’s just not okay.

If you haven’t read ‘I am Adam Lanzas Mother’ yet, you should. My brother could be the next Adam Lanza.

That’s all. I still believe in the right to have guns. I just believe in safely doing so.
